Critics see something else: a city government trying to push back against federal law enforcement.

Why Washington Is Fighting Back

The Trump administration has already moved hard against sanctuary jurisdictions. Where the Legal Fight May Go Next

The legal weakness in Mamdani’s move is the same one that has shadowed sanctuary politics for years. The order is broad inside city limits, but it does not bind private property owners the same way it binds city agencies.[6] It also relies on internal audits and agency compliance rather than outside enforcement.[6] That leaves room for challenge, especially if federal lawyers argue that the city is blocking lawful enforcement instead of managing its own operations.

Still, no public court ruling has yet struck down this order.[8] That matters because political shouting and legal reality are not the same thing. For now, Mamdani is betting that public anger at federal immigration enforcement will outweigh the risk of confrontation. Trump is betting that sanctuary politics still sell as lawless government overreach.
