Senate Committee Blocks Biden-Nominated Judge

(RepublicanPress.org) – On April 24, President Joe Biden nominated Judge Sarah Netburn for the US District Court for the Southern District of New York. The nominee has an extensive judicial background in the state, following a law clerk position at the US Court of Appeals for the Ninth Circuit justice in the early 2000s. However, it appears she will not assume her nominated position.

On July 11, the Senate Judiciary Committee voted 11 to 10 against Netburn. According to reports, the senators took issue with a previous ruling by the judge involving a serial offender. Multiple sources told the Washington Beacon that Netburn allowed an inmate with child abuse convictions to be housed in a women’s prison.

The criminal, who is transgender, goes by the name July Justine Shelby and was born William McClain. The report said Netburn ignored concerns that the criminal would pose a threat to the women in the prison. Shelby was accused of indecent conduct in front of other inmates. Prison officials did not confirm or deny the allegations, but the senators on the committee weren’t taking a chance that the reports were true.

Senator Ted Cruz (R-TX) spoke to the nominee about the alleged incident, stating Netburn “took a six-foot-two” offender and put that person in a female prison upon request without a worry. The Texas lawmaker called the judge a “radical,” claiming that she “endangered” the rights of the women in that prison and said Netburn had “no business being a judge.” The nominee reportedly responded to Cruz’s words by stating that “every person who is incarcerated has a right to feel safe in their space.”

Netburn reportedly disagreed with the idea that there was any threat to placing the convict in a female prison. In 2022, when the apparent rehousing took place, the judge reportedly wrote that the Federal Bureau of Prisons failed to prove that the convict would pose a danger to other prisoners, stating that Shelby was “under consistent mental health counseling and medication management.”
