(RepublicanPress.org) – On May 17, the US Supreme Court (SCOTUS) agreed to hear arguments in Dobbs v. Jackson Women’s Health Organization, a Mississippi abortion case. Republicans believe they now have their best shot of overturning Roe v. Wade in decades, with the Supreme Court’s conservative justices outnumbering Liberals by a six-to-three margin.
On July 29, Florida Gov. Ron DeSantis joined a group of 10 other Republican governors and became a signatory on an amicus curiae (friend of the court) brief. It encourages the nation’s highest court to overturn Roe v. Wade (1973) and another landmark abortion case, Planned Parenthood of Southeast Pennsylvania v. Casey (1992).

Attorneys for DeSantis and the other governors made two arguments in their brief. First, they claimed the court impermissibly intruded in States sovereignty in Roe v. Wade by misapplying the Due Process Clause of the US Constitution’s 14th Amendment. In short, “the Fourteenth Amendment… does not include the right” to an abortion.
Second, the lawyers argued returning the matter of abortion to the states would “produce positive results,” like “de-escalating tensions” resulting from the controversy surrounding the practice of abortion.
SCOTUS is scheduled to hear arguments in Dobbs v. Jackson during its fall term, and a decision isn’t expected until June 2022.
